UPDATE: as of 4:45PM Occupy Houston was told by HPD that we will NOT be kicked out of Hermann Square Plaza tonight.

On October 5th Mayor Parker announced that Occupy Houston could NOT be evicted from Hermann Square Plaza, yet today demonstrators were told by HPD’s Criminal Intelligence Division that any occupiers would be kicked out at 7pm or face arrest. The video below shows the mayor clearly issuing the order that Occupy Houston CANNOT be evicted. Start watching at 1:20.
Occupy Houston is currently talking with local media in the hopes we can get good coverage of what is looking to be a showdown. COME OUT!

I hope it turned out to be a good night. We recorded the news and channel 11 evening news also said that PD was going to have you leave at dark, but then 10pm news looked like you were still in the park. You might want to let legal know (we noticed it on the news) that the sign that says when the park is closed ..says from dawn to dusk, not dusk to dawn. Which would actually mean the park is only open at night. Seriously it says the park is closed from dawn to dusk…lol

OccupyHouston protest activity is “constitutionally protected speech.” OccHou’s protests are also protected by the 1st Amendment clause: “right to peaceably assemble to seek redress of grievance from government.” Therefore, city ordinances regarding day and night use of public spaces DO NOT APPLY.
I am one of the lawyers with “OH legal volunteers.” The OH core committees are doing an excellent job in helping to educate participants’ per 1st Amendment rights. The best protection of the people’s rights is for the people to get involved with this historical phenomenona. Come to the General Assemblies and other meetings
